SECTION 4 – BUSINESS MODEL AND THIRD PARTIES ROSE STORE operates as a dropshipping store. Products are managed and shipped through AutoDS and its network of third-party suppliers. By making a purchase, you agree that your shipping data (name, address and order details) will be shared with AutoDS solely for fulfillment purposes. We do not sell or transfer your data to third parties for commercial purposes.

SECTION 5 – PRODUCTS AND SERVICES Some products may be available exclusively online. These may have limited quantities and are subject to return or exchange only in accordance with our Return Policy. We reserve the right to limit the sales of our products to any person, geographic region or jurisdiction.

SECTION 6 – PRICING AND PAYMENTS Prices are expressed in US dollars (USD). We accept payments via PayPal and Mercado Pago. We reserve the right to modify prices at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension or interruption of the service.

SECTION 7 – BILLING AND ACCOUNT ACCURACY We reserve the right to refuse any order. We may limit or cancel quantities purchased per person, per household or per order. If we make a change to an order, we will attempt to notify you using the email or billing address provided.

SECTION 8 – OPTIONAL TOOLS We may provide you with access to third-party tools over which we have no control. You acknowledge that we provide access to such tools "as is" without warranties of any kind.

SECTION 13 – PROHIBITED USES In addition to other prohibitions set forth in the Terms of Service, you are prohibited from using the site to: (a) unlawful purposes; (b) solicit others to perform illegal acts; (c) violate international regulations; (d) infringe intellectual property rights; (e) harass, abuse or discriminate against others; (f) submit false or misleading information.

SECTION 14 – LIMITATION OF LIABILITY ROSE STORE shall not be liable for indirect, incidental or consequential damages arising from the use of our products or services, including delays caused by carriers, customs or third-party suppliers.

SECTION 15 – INDEMNIFICATION You agree to indemnify and hold harmless ROSE STORE and its employees from any claims arising from your breach of these Terms of Service.

SECTION 16 – GOVERNING LAW These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Peru. Any dispute shall be resolved under the jurisdiction of Peruvian courts.

SECTION 19 – WARRANTIES Products sold at ROSE STORE are subject to the legal warranties applicable in the buyer's country. For customers in the European Union, a minimum legal warranty of 2 years applies in accordance with Directive 2019/771/EU. In the event of a defective product, the customer must contact us within the legal timeframe at beverlycollantes1993@gmail.com to arrange the appropriate solution.

For customers outside the EU, warranties are governed by applicable local legislation. ROSE STORE does not offer additional warranties beyond those required by law.

SECTION 20 – DISPUTE RESOLUTION In the event of any dispute related to a purchase, we ask that you first contact us directly at beverlycollantes1993@gmail.com to seek an amicable solution within 15 business days.

If no agreement is reached, disputes will be resolved in accordance with the laws of Peru for customers outside the EU. For customers in the European Union, they may resort to the EU online dispute resolution platform: ec.europa.eu/consumers/odr.

Payments made through PayPal or Mercado Pago are also subject to the dispute resolution processes of those platforms.
